1. Copyright Infringement Notification (DMCA Takedown Notice)

If you believe that content available on MomentBook infringes your copyright, you may send a written notification ("Takedown Notice") to our Designated Copyright Agent. Your Takedown Notice must include:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the infringing material and information reasonably sufficient to permit us to locate it (including specific URLs where the material may be found)
  • Your contact information: full name, physical address, telephone number, and email address
  • A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  • A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf

2. Counter-Notification Procedure

If your content was removed or access to it was disabled as a result of a Takedown Notice, and you believe the removal or disabling was the result of a mistake or misidentification, you may send a written Counter-Notification to our Designated Copyright Agent. Your Counter-Notification must include:

  • Your physical or electronic signature
  • Identification of the material that was removed or to which access was disabled, and the location where the material appeared before it was removed or access was disabled
  • A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material
  • Your full name, physical address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if you are located outside the United States, the judicial district in which MomentBook's operator is located), and that you will accept service of process from the person who filed the original Takedown Notice or an agent of that person

3. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, MomentBook will, in appropriate circumstances, terminate the accounts of users who are repeat infringers. We may also suspend or terminate accounts based on a single instance of egregious infringement, at our reasonable discretion.

5. Other Intellectual Property Complaints

We will review and respond to such complaints as appropriate.

6. Policy Updates

We may update this policy from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons. Changes will be posted on this page with an updated effective date.
